Participant agreement

Liability waiver and release

Every participant signs this agreement at check-in before playing in an OVP event.

1. What this covers

In this agreement, OVP means Outdoor Volleyball Players, along with its organizers, directors, officials, staff, volunteers, sponsors, and the owners and operators of the facilities where its events are held. Participant means any person who plays, coaches, officiates, or otherwise takes part in an OVP event.

By registering for and taking part in an OVP event, the participant agrees to everything below.

2. Assumption of risk

Beach volleyball is a physical sport played outdoors, and it carries risks that cannot be removed no matter how carefully an event is run. The participant understands and accepts those risks, which include but are not limited to:

The participant takes part voluntarily and accepts full responsibility for any risk of injury, illness, death, or property loss that comes with it, whether the risk is obvious or not.

3. Release of liability

To the fullest extent allowed by Florida law, the participant releases OVP from any and all claims, demands, causes of action, damages, and expenses of any kind arising out of or related to participation in an OVP event, including claims based on the negligence of OVP. The participant agrees not to sue OVP over any such claim, on their own behalf or on behalf of their heirs, family, or estate.

This release does not apply to conduct that is grossly negligent, intentional, or otherwise cannot be released under Florida law.

4. Indemnification

The participant agrees to defend, indemnify, and hold OVP harmless from any claim, loss, liability, or expense, including reasonable attorney fees, brought by the participant or by anyone else as a result of the participant's actions at an OVP event.

5. Medical fitness and treatment

The participant confirms they are in good enough physical condition to compete, they have no medical condition that would make participation unsafe, and they are responsible for their own health insurance. OVP does not provide medical or accident insurance for participants.

If the participant is injured or becomes ill at an event and cannot make decisions for themselves, they authorize OVP to arrange emergency medical treatment or transport on their behalf, and they accept responsibility for the cost of that care.

6. Photos and video

OVP takes photos and video at its events. The participant grants OVP permission to use their name, image, likeness, and playing results in photos, video, results, and promotional material connected to OVP and its events, in any format, without payment or further approval.

7. Rules and conduct

The participant agrees to follow the event rules and format, to compete in the correct division, and to treat other players, officials, staff, and the venue with respect. OVP events are player reffed and follow AVP sanctioned rules.

Conduct is handled with a yellow card warning. The tournament director reserves the right to award a red card, which disqualifies that player and their team without a refund. OVP may also remove any participant for unsafe conduct, abusive behavior, or damage to the venue.

8. Participants under 18

A participant under 18 years old may only take part with the signature of a parent or legal guardian. By signing, the parent or guardian agrees to everything in this document on the minor's behalf and on their own behalf, including the assumption of risk, release, and indemnification sections above.

9. Entry fees and cancellation

Entry fees hold a team's spot in a division. Events run rain or shine when conditions are safe. If OVP cancels or shortens an event for weather, safety, or venue reasons, refunds are at the discretion of the event director and may be issued as a credit toward a future OVP event.

10. General

This agreement is governed by the laws of the State of Florida. If any part of it is found unenforceable, the rest stays in effect. This is the complete agreement between the participant and OVP on the subjects it covers, and it binds the participant's heirs, family, and estate.

11. Acknowledgment

By signing at check-in, the participant confirms they have read this agreement, understand that it releases legal rights and limits liability, and are signing it freely.
